International Grants Administration and Compliance

All grants recommended for funding by FLI to the FLI Fund (our Donor Advised Fund) are reviewed and approved by Silicon Valley Community Foundation. Grants to international organizations without a 501(c)3 determination letter require further due diligence through Equivalency Determination or Expenditure Responsibility in order to ensure regulatory compliance in accordance to U.S. Tax Law. However, if your organization is affiliated with a U.S. public charity or intermediary organization, please let us know immediately so that we can expedite the grant recommendation through our grant process for U.S. public charities without the additional paperwork that is required of a non-501(c)3 organization.

Equivalency Determination: During this process, the community foundation will request an affidavit and documents from your staff to determine whether your organization is the equivalent of a U.S. 501(c)3 public charity. All documents must be submitted in English and the length of the due diligence process will depend on the nature of your organization or institution and its ability to provide the necessary paperwork.

Expenditure Responsibility: This process is required for grants to an organization that is not considered a public charity but performs charitable work. During this process, the community foundation will perform a pre-grant inquiry with your staff to verify the charitable nature of the project for which funding is being recommended and to evaluate your organization’s ability to carry out the purpose of the grant. Grants awarded through this method of due diligence require that the grant funds are maintained in a separate account and require one or more reports.

Upon receipt of a grant recommendation to your organization, community foundation staff will contact your organization. If your organization has designated development or fundraising staff, please be sure to let us know. The information we need is often most easily accessed by staff in these areas. Your assistance will help community foundation staff efficiently evaluate and process the recommended grant to support your work.
